What Inspires You? Video Contest
NO PURCHASE NECESSARY TO ENTER OR WIN. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES. NO COMPETING BRAND OR VISUALS CAN BE SUBMITTED. VIDEOS THAT MENTION OR SHOW COMPETING BRANDS WILL NOT BE APPROVED FOR SUBMISSION. VOID WHERE PROHIBITED.
I. VIDEO SUBMISSION PERIOD: The What Inspires You? Video Contest (the “Contest” or “Promotion”) begins on or about 09:00 a.m. January 15, 2019 (“Start Date”) and ends at 11:59:59 p.m. on February 15, 2019 (the “Entry Period”). The Contest is sponsored by, Okuma Fishing New Zealand (the “Sponsor” and “Prize Supplier”). The official clock for purposes of the Contest is the computer of the Sponsor.
II. ELIGIBILITY: The Contest (“Contest”) is open solely to a parent or legal guardian who is eighteen (18) years of age or older, a resident of New Zealand. To participate in the Contest, contestants must have Internet access and a valid email address. Officers, directors and employees of Okuma NZ, its subsidiary and affiliated organizations or companies, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively, the “Released Entities”), and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to enter or win. The Contest is subject to all applicable New Zealand laws and regulations. Participation constitutes a parent, a family member (grandparent, aunt, etc.) or legal guardian who actively creates and enters a video of their child according to entry requirements as defined in Section III. The parent or legal guardian will be deemed a participant (“Participant(s)” or “you”) in these Official Rules (“Official Rules”). Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Contest. Entry constitutes a Participant’s certification that he/she meets the eligibility requirements set forth in these Rules. Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon fulfilling all requirements set forth herein. Prize winner must be available to complete the fishing trip which will take place on the first weekend of March 2019.
III. HOW TO ENTER: Participants are invited to enter the What Inspires You? Video (“Video”) and Photo (“Photo”) Contest by creating a Video clip of yourself stating what inspires you to get on the water to fish. Participants are encouraged to be as creative as possible, showcase your personality to demonstrate why you should be chosen. Use of props or other creative treatments is highly encouraged. (Refer to Section IV for Video Guidelines and Content Restrictions)
IV. Video and Photo Submission Entry Steps: You must submit your video or photo between 15/01/19 (9 AM EST) thru 15/02/19 (11:59 PM). Content received after the Submission Period are automatically disqualified. Video and Photo Submission Entry Steps:
- Upload your photo or video onto either Youtube, Facebook or Instagram
- Tag OkumaNZ and hashtag #inspiredfishing #okumaNZ
- Please make the post public. If the video or photo cannot be viewed it won’t be entered. (Your video should be between 1 and 2 minutes in length and HD quality with clear audio.)
- Visit the website at https://www.cdrods.co.nz/competition-entry
- Enter your details and add the link of your Video or photo
- Make sure to review the terms and conditions before checking the box
- Click “Enter” to submit your photo or video entry
V. VIDEO GUIDELINES AND CONTENT RESTRICTIONS: The Video MUST BE no shorter than 30 seconds and no longer than 2 minutes in length. The Sponsor reserves the right to disqualify any Video Submission that in its sole judgment does not meet these standards. The Video must address what inspires you to get out on the water and fish. You must be in plain view of the camera. All Videos must be submitted in English. A completed and submitted Video is final and may not be modified or edited further and becomes property of the Sponsor. The Video, and the components thereof, must be the original work of the Participant, and must have been created in a legal and safe manner. An original is the product of one’s own mind and is not a copy or imitation. If the Video contains any material or elements that are not owned by the Participant and/or are subject to the rights of third parties, the Participant is responsible for obtaining, prior to Submission of the Video, any and all releases and consents necessary to permit the use and exhibition of the Video and all of the components thereof by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who appears in or is identifiable in the Video, and permission to reproduce, distribute, publicly display or otherwise use the Video (collectively, the “Clearances”). By submitting a Video, Participant warrants, represents and consents to the Submission and use of the Video in the Contest, and to its posting on Sponsor’s social media platforms in connection with the Contest.
VI. RIGHTS: Uploading a Submission constitutes a Participant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, creative, media or technology now known or later developed, including for promotional or marketing purposes. If requested, Participant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights Participant is granting to use the Video Submission. Released Entities (as defined in Section II) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Video Submissions; all of which will be void.
VII. CONTEST WINNER DETERMINATION: The Video, photo Contest is a skill-based Contest, and chance plays no part in the determination of the Top three contestants. Submissions will be judged by a qualified panel of judges, selected by the Sponsor in its sole discretion. Each Submission will be judged according to the clear relationship between the content and the What Inspires You? theme. Judging is based upon the following criteria: production value and overall story of inspiration. The top three will then have their content posted on the OkumaNZ facebook page. The most Post likes by Friday 22 February 2019 will be the Winner. The Winners will be notified by email on or about February 25, 2018. The Judges’ decisions are final and binding in all matters relating to this Contest.
VIII. PRIZE: One (1) Grand Prize Winner will be awarded a 2-nights and 3-days stay in a accommodation decided by Sponsor, round trip travel from Auckland for two (2), 2 days of fishing. All other food, travel costs will be included on location. Sponsor will provide fishing tackle and necessary equipment. One (1) second place winner will receive a $700 gift card to spend on Okuma products.
IX. GRAND PRIZE CONDTIONS: While the Prize Supplier will make every effort to confirm reservations as requested, operational and/or market conditions may prevent them from doing so on your requested dates. Accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at Sponsor’s sole discretion. Grand prize will have to be redeemed on the 1/03/2019. If no suitable dates can be found, a prize of a $1500 gift to be spent on Okuma products will be substituted. Prizes are not transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. Prize details and availability are subject to change, and in the event that Sponsor is unable to provide the Winner with the Prize won, the Sponsor may elect, at the Sponsor’s sole and absolute discretion, to provide Winner an alternate prize. The stated ERV of the Prize is based on available information provided to Sponsor at the time these Official Rules were drafted and the value of the Prize awarded to a Winner will be reported for tax purposes as required by law. An unclaimed Prize will be forfeited. A properly claimed Prize will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any Prize awarded in this Contest. All decisions by Sponsor as to Winner and the Prize are final. All expenses not specifically mentioned herein, are not included as part of the What Inspires You? Contest Prize, and are solely the Grand Prize Winner’s responsibility, including, but not limited to: travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, gratuities and service charges, site-seeing excursions and any other incidental costs or expenses not identified in these Official Rules. Sponsor is not liable for, and no refund or compensation will be made in the event of a cancellation, except at the sole and absolute discretion of Sponsor. Travel companions must execute a liability/publicity waiver (“Companion Waiver”) prior to issuance of Prize documents. If a travel companion is a minor, the parent or legal guardian must sign and return the Companion Waiver and accompany the minor on the What Inspires You? Contest Prize. If the Winner becomes disabled or cannot otherwise fully enjoy the What Inspires You? Contest Prize due to illness, Sponsor shall have the option of: (a) being relieved of liability for fulfillment of the prize award; or (b) at Sponsor’s sole and absolute discretion, extend the period during which the Prize may be awarded for a period equal to the duration of the Prize Winner’s disability or illness, in which case certain Prize components may not be available. The Winner must prove such disability by a doctor’s certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Winner.
X. GENERAL PRIZE TERMS AND CONDITIONS: The Grand Prize Winner is required to comply with any and all applicable National and local laws, rules and regulations. The stated “ERV” of the Prize is based on available information provided to Sponsor at the time these Official Rules were drafted (and any difference in ERV at the time of awarding will not be awarded) and the value of any Prize awarded to the Winner may be reported for tax purposes as required by law. The Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prize they receive.
XI. LIMITATIONS OF LIABILITY: If this Contest is not capable of running as planned for any reason, including, less than 20 entrants or, without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Contest, in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Any person who supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law. Released Entities assume no responsibility for any incomplete, incorrect, or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error. Released Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Entities are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer (or any information/material stored therein) relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
XII. USE OF PERSONAL INFORMATION/OPT IN: By entering via the Sponsor’s application page, you consent for the Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Contest; the information that you provide in connection with the entry process will be used by Sponsor only, and will not be sold or provided to another company. You are authorizing the Sponsor to send you e-mails to the address entered on entry form, regarding products and services. You may opt out of receiving future e-mails from Sponsor by clicking on the link contained in the most recent e-mail received. You will remain eligible for this Contest whether or not you opt out of receiving promotional e-mails from the Sponsor.
XIII. RELEASES: All Participants, as a condition of participation in this Contest, agree to indemnify, release and hold harmless Sponsor and Released Entities from and against any and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Sponsor’s Website; (b) participating in any aspect of the Contest, including, without limitation, while preparing for, participating in and/or traveling to or from any Prize or Contest-related activity, including, without limitation, any injury, damage, death, loss or accident to person or property; (c) the receipt, ownership, possession, use or misuse of any Prize awarded; (d) viruses or any downloading or other problems with the Contest Application, or; (e) any typographical or other error in these Official Rules or the announcement of offering of any Prize. Prize Winner bears all risk of loss or damage to his/her respective Prize after it has been delivered.
